DRAFT FOR REVIEWHighlighted [PLACEHOLDERS] are still to be filled in, and the wording needs legal review.

Terms of Service

Effective date: [EFFECTIVE DATE]

In plain English: list your app, we help people find it. Your first app is free, extra apps are £5, Pro is £12 a month and you can cancel any time. Rankings are earned, never bought. If you leave, your listing comes down, but articles and podcast episodes we've already published may stay up.

1. Who we are

1.1 blymp.app (“Blymp”, “we”, “us”) is a trading name of WireNexus Ltd, a company registered in England and Wales (company no. [COMPANY NUMBER]), registered office [REGISTERED OFFICE ADDRESS].

1.2 Contact us at [CONTACT EMAIL].

1.3 These terms apply to your use of the Blymp website and services. By creating an account you agree to them, and to our Listing and Content Policy. Our Privacy Policy explains how we use your personal data.

2. Key terms

  • App: a software product you submit to Blymp (web app, mobile app, browser extension, plugin, template pack or similar productised tool).
  • Listing: your App's page in our directory and catalogue.
  • Snapshot: the automated customer report we create for your App (threads, competitors, search questions).
  • Idea Drop: a one-off report of evidenced app ideas.
  • Pro: our paid subscription (“Loud”), including Founding Pro.
  • Editorial Content: articles, comparison and alternatives pages, newsletters, social posts and podcast episodes we publish that mention Apps.

3. Your account

3.1 You must be 18 or over and give accurate details. You're responsible for keeping your login secure and for activity on your account.

3.2 An account belongs to one person. If you sign up on behalf of a business, you confirm you're authorised to accept these terms for it.

3.3 You must verify your email address before Snapshots run.

4. Plans and prices

4.1 Prices are in pounds sterling. [Prices include VAT / VAT is added at checkout where applicable.]

4.2 A 4th or further App on Pro costs £5 per App. An Extra App you've paid for stays on your account permanently, even if you change plan.

4.3 Founding Pro price applies only while your subscription runs continuously. If you cancel or your payment fails and the subscription ends, any later subscription is at the standard Pro price.

4.4 We may change prices for new purchases at any time. For existing subscriptions we'll give at least 30 days' notice by email before a price change applies to your next renewal, and you can cancel before it does.

5. Payments

5.1 Payments are processed by Stripe. We don't store your full card details.

5.2 Subscriptions renew automatically at the end of each monthly or yearly period until cancelled.

5.3 If a renewal payment fails, we'll try again and let you know. If it still fails, your account moves to Whisper (see section 13).

5.4 Refunds and your cancellation rights are explained in our Refunds and Cancellations policy, which forms part of these terms.

6. Listing your App

6.1 You may list Apps you own or are authorised to promote. Blymp lists products, not services; see the Listing and Content Policy for what can and can't be listed.

6.2 You're responsible for the accuracy of the information you give us, including pricing, features and claims about results, and for keeping it up to date.

6.3 We may review, edit for clarity or formatting, refuse or remove any Listing that breaks these terms or the Listing and Content Policy, or that we reasonably think could harm users or our reputation. We'll tell you why where we can.

7. The licence you give us

7.1 You keep ownership of your App, name, logo, screenshots and the content you submit.

7.2 You give us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt (for formatting and length) and display that content, and your App's name and logo, to run your Listing and to create and promote Editorial Content.

7.3 For your Listing, this licence ends when the Listing is removed. For Editorial Content already published, the licence continues, so that published articles and episodes can stay live (see section 13).

7.4 You confirm you have the rights to everything you submit and that it doesn't infringe anyone else's rights.

8. Snapshots, reports and insights

8.1 Snapshots and Idea Drops are produced automatically, partly using AI, from publicly available information such as search results, forums, app stores and review sites. They're for information only.

8.2 We work hard to make them useful, but we don't guarantee they're complete, accurate or up to date, or that they'll lead to customers, sales or rankings.

8.3 Threads and pages we point you to belong to third parties. If you engage with them, follow each community's rules and don't spam. We're not responsible for third-party sites or content.

8.4 Reports are for your own use. Don't resell or republish them in bulk.

9. Rankings and editorial independence

9.1 Top picks, App of the Month, curated positions and podcast selection are decided by us on merit. They can't be bought, and paying for any plan doesn't guarantee them.

9.2 We decide what Editorial Content to publish, what it says and which Apps it includes. We aim to be fair and accurate; you can ask us to correct factual errors about your App at any time.

10. Podcast

Any listed App can apply to be featured on the AI Automations for Business podcast. Applying is free and is a chance to be featured, not a guarantee. Applications and appearances are covered by our Podcast Guest Terms and Release.

11. Availability checks

We check listed Apps regularly to make sure they're still online. If an App can't be reached, it may be marked “No longer available” after warnings, with a way to fix or appeal. The process is set out in the Listing and Content Policy.

12. Acceptable use

You must not:

  • submit Apps that are illegal, harmful, deceptive, malware, or that break our Listing and Content Policy;
  • scrape, copy or harvest our directory, reports or data, or use automated tools to access the service other than through features we provide;
  • try to manipulate rankings, reviews or votes, or create multiple accounts to get free Snapshots;
  • interfere with, reverse engineer or overload the service;
  • use the service to harass anyone or send spam.

We may suspend or close accounts that break these rules.

13. Cancelling, downgrading and deleting your account

13.1 Cancelling Pro: you can cancel at any time in your billing settings. Your Pro features continue until the end of the period you've paid for, then your account moves to Whisper.

13.2 On Whisper after Pro: you keep all Apps already listed. Weekly refreshes, AI visibility tracking and any Founding Pro price end. New Apps cost £5 each.

13.3 Deleting your account: you can delete your account at any time. We'll remove your Listings from our directory and catalogue and delete your personal data in line with our Privacy Policy.

13.4 Published Editorial Content: Editorial Content that mentions your App and was published before you deleted your account may stay published. We won't be obliged to edit or remove it, but we'll correct factual errors on request and may remove mentions at our discretion.

13.5 Our right to end the service for you: we may suspend or close your account if you seriously or repeatedly break these terms. If we close a paid account for reasons other than your breach, we'll refund any unused prepaid subscription period.

14. Our intellectual property

The Blymp name, brand, website, software, reports and Editorial Content belong to us or our licensors. You may share links to your Listing, badges and episodes we provide, and quote short extracts with attribution.

15. Third-party services

We rely on third parties such as payment, hosting, data and AI providers. We're not responsible for their services, but we choose them carefully (see our Privacy Policy).

16. Our responsibility to you

16.1 Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't legally be limited, or affects your legal rights as a consumer.

16.2 If you use Blymp for business purposes: we're not liable for loss of profit, revenue, business, opportunity or data, or for any indirect or consequential loss. Our total liability is limited to the greater of £100 or the amount you paid us in the 12 months before the claim.

16.3 If you're a consumer: we're responsible for loss or damage you suffer that's a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We're not responsible for loss that isn't foreseeable, or for business losses.

16.4 The service is provided as it is. We don't promise it'll be uninterrupted or error-free, or that any App will gain customers, traffic or rankings.

17. Changes

17.1 We may update the service and these terms. If a change materially affects you, we'll give you at least 30 days' notice by email. If you don't agree, you can cancel before the change takes effect.

17.2 We may make minor or legally required changes without notice.

18. Complaints

If something's gone wrong, email [CONTACT EMAIL]. We'll reply within 5 working days and try to sort it out quickly.

19. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you're a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
